TERMS AND CONDITIONS

Summstoff Imkereigenossenschaft e.G. (hereinafter referred to as Summstoff.de ) operates the website Summstoff.de for commercial purposes and offers various products there. The following terms and conditions also contain the information required by law about your rights under the regulations on distance contracts and electronic commerce.

1. SCOPE

(1) The following General Terms and Conditions (T&Cs) apply to all deliveries by Summstoff.de when selling to businesses and consumers via this website www.Summstoff.de .

(2) A business within the meaning of Section 14 of the German Civil Code (BGB) is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, is acting in the exercise of its commercial or independent professional activity.

(3) A consumer within the meaning of Section 13 of the German Civil Code (BGB) is any natural person who enters into a legal transaction for purposes that cannot be attributed predominantly to either their commercial or their independent professional activity.

3. OFFER AND CONCLUSION OF CONTRACT

(1) The offers of Summstoff.de at www.Summstoff.de are a non-binding invitation to the customer to order goods.

(2) Once you have found the product you want, you can place it in the cart without obligation by clicking the [Add to cart] button. You can view the contents of the cart at any time by clicking the cart icon. You can remove the products in the cart from the cart again at any time by clicking “Remove”. You can change the desired quantity of the item using the quantity selector (plus/minus). If you want to buy the products in the cart, click the [Checkout >] button. Here you enter your details. When you then click [Confirm>], you reach the order overview; there your details are checked and you can select the desired payment method. Here you can check your entries once more and, if necessary, correct input errors using your browser's back button or by clicking the step labels above (Order – Address – Payment). The process can also be cancelled at any time by closing the browser window. You then complete the order process by clicking the [order with obligation to pay] button.

(3) By ordering the desired goods, the buyer submits a binding offer to conclude a purchase contract.

(4) The contract is concluded when the seller accepts the offer, by our sending an order confirmation by email within 1-2 days or by delivery of the goods. Otherwise, the offer is deemed rejected.

4. RIGHT OF WITHDRAWAL

Consumers have a right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that cannot be attributed predominantly to either their commercial or their independent professional activity.

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, who is not the carrier, took possession of the last of the goods.

To exercise your right of withdrawal, you must inform us

You can use our model withdrawal form for this purpose (available here), although this is not mandatory.

You can also complete and submit the model withdrawal form, or any other clear statement, electronically on our website summstoff.de/widerruf If you make use of this option, we will send you confirmation of receipt of such a withdrawal without delay (e.g. by email).

To meet the withdrawal deadline, it is sufficient for you to send the notification that you are exercising your right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we must reimburse to you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this repayment we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. We may refuse repayment until we have received the goods back or until you have provided proof that you have sent back the goods, whichever is the earlier.

You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods. Items that cannot be sent by parcel will be collected from you.

You are only liable for any diminished value of the goods if this diminished value results from handling of the goods that is not necessary for examining the nature, characteristics and functioning of the goods.

1. The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.

2. Non-binding notes on returning the goods

Please do not return the goods to us unpaid (carriage forward). In the event of withdrawal, we will of course transfer the purchase price back to your account. The exercise of your statutory right of withdrawal is not affected by the notes listed under item (2).

5. DELIVERY TIME

(1) We dispatch your goods within two working days after your order and subject to availability or, for prepayment methods, within 3 working days after you have made the payment. Sundays and public holidays must be taken into account. Barring problems with the commissioned shipping company that we cannot foresee, the delivery will therefore reach you within 3-4 working days after your order or, for prepayment methods, within 4-5 working days after you have made the payment. If delivery times differ in individual cases, this is indicated on the respective product page. Should the goods not reach you within the time we have stated because of an unforeseeable delay at the commissioned shipping company, please let us know without delay so that we can make enquiries with the shipper. The stated delivery times apply to domestic shipping. Shipping abroad, where offered, may take 3-4 working days longer.

(2) If, despite having concluded a covering transaction, delivery difficulties arise for which we are not responsible, we reserve the right to withdraw from the contract. You will be informed of this without delay by email and, where applicable, we will propose the delivery of a comparable product. If no comparable product is available or you do not wish to receive a comparable product, we will refund without delay any payments you have made to date. Your statutory rights are not affected by this.

6. RETENTION OF TITLE

(1) For consumers the following applies: the goods you have purchased remain our property until full payment has been made.

(2) For businesses the following applies: the goods you have purchased remain our property until full payment of all claims arising from the business relationship.

7. PRICES AND SHIPPING COSTS

(1) The prices stated on the product pages include the statutory value added tax of 7% and other price components, and are shown separately on the invoice.

(2) For parcel goods we charge €6.99 for shipping within Germany. Should the shipping costs differ in individual cases, they will be listed separately on the respective product page. You can also view the amount of the shipping costs incurred in the cart at any time before placing your order.

(3) In accordance with the statutory provisions on the sale of consumer goods, shipping is at our risk. If the buyer is a business, the transport risk passes to the buyer as soon as the goods are handed over to the carrier.

8. PAYMENT

In principle, we offer the following payment methods: PayPal, credit card, prepayment. For each order we reserve the right not to offer certain payment methods and to refer you to other payment methods. If you select prepayment as the payment method, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment. If you pay by one of the other payment methods, your account will be debited when the goods are ordered. You can find further information on the Payment information page.

9. STATUTORY 
WARRANTY FOR DEFECTS

(1) For sales to consumers, the statutory warranty period of 2 years applies.

(2) For sales to businesses the following applies: the warranty period is one year and begins on the date the item is delivered. The rights of the business under Sections 478, 479 remain unaffected. The shortening of the warranty period to one year does not apply if the liability to pay compensation is based on injury to life, limb or health due to a defect for which the seller is responsible, or on gross negligence on the part of the seller or its vicarious agents. Notwithstanding this, the seller is liable under the Product Liability Act.

10. CONTRACT LANGUAGE

The contract language is German.

11. STORAGE OF THE CONTRACT TEXT

We do not store the contract text. You can save the contract text by printing the offer using your browser's print function. You would have to arrange storage of the contract text in a reproducible form yourself (e.g. by taking a screenshot of the respective offer or converting the contract text to PDF format).
